EakLab Cancellation Policy

Last Updated: September 10, 2026

At EakLab, we understand that business requirements, project priorities, timelines, and circumstances can change. Whether you are working with us on digital growth, software development, data engineering, systems integration, or AI transformation, we aim to maintain a clear and transparent process throughout our engagement.

This Cancellation Policy explains the general principles that apply when a client wishes to cancel, pause, or discontinue a service or project with EakLab.

Cancellation Policy EakLab

EakLab provides capabilities across Growth, Engineering, Data, and AI, including performance marketing, organic marketing, web development, mobile app development, custom software development, ecommerce development, product engineering, data analytics, DevOps, systems integration, API development, and AI transformation. Because the scope, duration, and commercial structure of these services can differ from one engagement to another, specific cancellation terms may also vary depending on the applicable agreement or proposal.

Important: The exact notice periods, cancellation charges, refund terms, and financial obligations should be finalized by EakLab and reflected in the applicable service agreement, proposal, statement of work, order form, or other contractual document.

1. Scope of This Cancellation Policy

This Cancellation Policy applies to services and engagements provided by EakLab where a client requests to cancel, pause, or discontinue an engagement.

It should be read together with any applicable:

  • Service Agreement
  • Statement of Work (SOW)
  • Proposal
  • Order Form
  • Service Level Agreement (SLA)
  • Terms of Service
  • Project-specific commercial terms
  • Other written agreements between EakLab and the client

Where a signed agreement contains specific cancellation provisions, those provisions will govern the relevant engagement.

2. Requesting Cancellation

Clients who wish to cancel a service or project should submit a cancellation request through the communication channel specified in their agreement with EakLab.

A cancellation request should, where applicable, include:

  • Client or organization name
  • Relevant project or service name
  • Requested cancellation date
  • Reason for cancellation, if the client wishes to provide one
  • Any other information reasonably required to identify the engagement

A cancellation request does not automatically mean that all services stop immediately. The effective cancellation date will depend on the applicable contractual terms, notice requirements, project status, and any outstanding obligations.

EakLab will communicate the applicable next steps after receiving a cancellation request.

3. Cancellation of Ongoing Services

For recurring or ongoing services, cancellation may require advance written notice in accordance with the applicable agreement.

This can apply to services such as digital marketing, performance marketing, organic marketing, technology support, managed services, consulting, or other continuing engagements.

During the applicable notice period, EakLab may continue performing the agreed services unless otherwise agreed in writing.

Any outstanding fees for services already delivered, approved work, committed resources, or other contractual obligations may remain payable according to the applicable agreement.

4. Cancellation of Project-Based Work

Project-based engagements may involve activities such as discovery, strategy, UX/UI, development, testing, integration, deployment, optimization, or other project deliverables.

If a client cancels a project after work has started, EakLab may be entitled to payment for work completed up to the effective cancellation date, along with any other amounts specifically agreed in the applicable contract.

Depending on the project, cancellation may also involve third-party costs, technology expenses, approved purchases, committed resources, or other non-recoverable costs.

The applicable proposal, statement of work, or agreement should define how these situations are handled.

5. Cancellation Before Work Begins

If a client requests cancellation before EakLab has started work, the applicable agreement will determine whether any fees are payable.

Where no specific cancellation terms have been agreed, EakLab may review the circumstances of the engagement, including whether resources have already been allocated, work has commenced, or third-party commitments have been made.

Any applicable refund or cancellation amount should be determined according to the commercial terms agreed between EakLab and the client.

6. Work Already Completed

Cancellation does not generally eliminate payment obligations for work that has already been completed or approved.

For example, if EakLab has already performed discovery, strategy, development, marketing, data engineering, integration, consulting, or other agreed services before cancellation, those services may remain chargeable according to the applicable agreement.

Where project milestones or deliverables have been completed before cancellation, the client may remain responsible for the corresponding charges.

This approach ensures that cancellation is handled fairly while recognizing the work, resources, and time already committed to the engagement.

7. Refunds

Any refund resulting from cancellation will be determined according to the applicable agreement and the circumstances of the engagement.

Refund eligibility may depend on factors such as:

  • Whether work has started
  • Services already delivered
  • Project milestones completed
  • Advance payments
  • Non-refundable third-party costs
  • Resources already committed
  • Contractual notice requirements
  • The specific cancellation terms agreed with the client

EakLab does not intend for this general policy to override specific refund provisions contained in a signed agreement.

Where a refund is approved, the applicable agreement or EakLab’s confirmed commercial process will determine the amount and method of processing.

8. Cancellation of Digital Marketing Services

Digital marketing engagements can involve campaign planning, account setup, advertising management, content, analytics, optimization, and other ongoing activities.

If a client cancels a digital marketing service, EakLab may require the applicable notice period stated in the engagement agreement.

Cancellation of EakLab’s service does not necessarily cancel third-party advertising accounts, media commitments, subscriptions, software tools, or other external services operated or purchased separately.

Clients remain responsible for third-party costs that they have independently incurred or authorized, subject to the relevant third-party terms.

9. Cancellation of Technology and Development Projects

For web development, mobile app development, custom software development, ecommerce development, product engineering, API development, systems integration, DevOps, or AI development projects, cancellation may occur at different stages of the development lifecycle.

For example, a project may have progressed through:

Discovery → Strategy → Design → Development → Integration → Testing → Deployment → Optimization

If cancellation occurs after work has progressed through one or more stages, EakLab may assess the completed work and applicable contractual obligations before determining the financial and operational consequences.

Where source code, designs, documentation, credentials, infrastructure, or other project materials are subject to specific contractual conditions, those conditions will continue to apply.

10. Pausing a Project

In some situations, a client may prefer to temporarily pause an engagement rather than cancel it completely.

A project pause may be considered where business priorities, internal approvals, budgets, technical dependencies, or other circumstances require additional time.

A pause should be agreed upon in writing and may include specific terms relating to:

  • Pause duration
  • Resource availability
  • Project timelines
  • Existing commitments
  • Restart requirements
  • Additional costs, where applicable

EakLab will determine whether a requested pause can be accommodated based on the project’s circumstances and available resources.

11. EakLab’s Right to Cancel or Suspend Services

EakLab may suspend or terminate services where permitted by the applicable agreement or law.

Potential circumstances may include:

  • Non-payment of applicable fees
  • Material breach of contractual obligations
  • Misuse of services
  • Failure to provide necessary information or access
  • Legal or regulatory requirements
  • Other circumstances specified in the applicable agreement

Where appropriate, EakLab may provide notice and an opportunity to resolve the relevant issue before suspension or termination.

12. Client Responsibilities After Cancellation

Following cancellation, the client may be responsible for completing outstanding obligations under the applicable agreement.

This may include payment of approved invoices, settlement of outstanding charges, or other agreed responsibilities.

Where applicable, the parties may also need to coordinate the transition of project information, systems, accounts, access credentials, documentation, or other materials.

The specific process will depend on the nature of the engagement and the contractual terms.

13. Effect of Cancellation on Data and Confidential Information

Cancellation of a service does not automatically remove confidentiality obligations or other provisions that are intended to survive termination.

Where EakLab has handled business information, project information, customer information, credentials, technical documentation, or other confidential material, the treatment of such information will be governed by the applicable agreement and relevant privacy or data-protection requirements.

Any data retention, deletion, transfer, or return requirements should be handled according to the applicable contractual and legal obligations.

14. Changes to This Cancellation Policy

EakLab may update this Cancellation Policy from time to time to reflect changes in its services, business processes, contractual practices, or applicable requirements.

When this policy is updated, the revised version may be published on the EakLab website with an updated effective or last-updated date.

Changes to this general policy will not automatically modify the specific contractual terms of an existing engagement unless expressly agreed or permitted under the applicable agreement.
